Briefly, patented technology may be used if the patent holder is willing to license it under "openly specified, reasonable, non-discriminatory terms". The WG may decide whether or not to use any patented technology. (An older policy had an explicit preference for unencumbered mechanisms. That policy was superceded by RFC 2026.) --Steve Bellovin
